What if a bidder changes his mind about my item after winning the auction?
When users register with this site and initiate bids on items in live auctions, they are bound by the User Agreement Terms & Conditions they accepted at the time of registration. That agreement gives sellers legal recourse in the case where irreconcilable differences prevent an equitable resolution of the issue.
SpecialtyCoffeeAuctions.com has initiated a process to help buyers and sellers resolve problems with purchases. There are steps that must be taken to assure that every avenue has been tried to resolve the issue where a bidder has not followed through on a sale. These policies primarily refer to Equipment & Supplies auctions.
Actions taken against the bidder include:
- First offense: Warning, after a seller has filed a Bidder Complaint.
- Second offense: Warning and 60 day suspension, unless the Bidder has filed a legitimate Bidder Complaint Appeal.
- Third offense: Indefinite suspension from buying and selling on SpecialtyCoffeeAuctions.com.
In an Equipment & Supplies auction, can the seller get a refund of the Listing Fee or Optional Fees if the buyer never comes through with payment?
Although a rare occurance, nothing can be ruled out, so how do we remedy the situation following a winning auction after the seller has been charged Listing or Optional Enhancement Fees? There are steps that must be taken to assure that every effort has been made to contact the bidder. If a bidder doesn't go through with the purchase, then you will be given a credit to your account for the fees you have paid for your item listing.
The following steps must be taken if you are an equipment & supplies seller and have a bidder that is not following through on a purchase:
- Try to make contact several times after the auction has ended. Things can come up. Bidders can have an emergency, or their computer may not be working. Give the buyer a chance to get back to you. Many people do not check their e-mail every day, so you may consider calling them on the phone. This is often the easiest and quickest way to get in touch with someone.
- After the auction item is closed for seven business days, the seller can file a Bidder Complaint. This allows the bidder time to contact the seller.
- When SpecialtyCoffeeAuctions.com receives this complaint, we will attempt to contact the bidder and encourage them to go through with the purchase. A Bidder Complaint MUST be filled out within thirty days of the auction closing or it will be deemed invalid.
- During the next ten days, try to resolve things with your buyer and complete the purchase.
- If ten days have gone by since filing a Bidder Complaint, and the purchase is still not resolved, the seller may file for a Credit Request. The Credit Request MUST be received within sixty days of the auction closing. If these procedures have been followed and a refund is found to be a legitimate remedy, a credit will be applied toward future transactions.

What recourse do I have if the coffee I receive is substantially different from the sample I received for that auction item?
For coffee lot auctions, SpecialtyCoffeeAuctions.com through its parent company, Intellidon Enterprises, serves as the legal seller and should be contacted directly if you feel, upon arrival, the coffee lot doesn't match the sample you received prior to the start of the auction.
Because origin coffee sellers are both reputable organizations and professionally screened, this should not happen or only be a rare occurance. Often if an honest mistake is made, sellers may work with us to come to an appropriate resolution.
In any case, SpecialtyCoffeeAuctions.com will have an original sample on file and will be able to evaluate and compare the coffee lot you received with the original sample sent to you. This will be the first step. If we agree that there is a significant difference in the coffee lot compared with the original sample, we will investigate further and work with you to come to an equitable solution.
Equipment & Supplies Seller Non-Performance
When a seller lists an item for sale in an Equipment & Supplies category and a buyer bids on that item and becomes the winning bidder, the seller and buyer have entered into a binding contract. As a result, both parties in this transaction are expected to honor that contract. Sellers have the same contractual obligations as buyers and may not:
- Fail to deliver an item when the winning bidder has either pre-paid or arranged for payment via a bank to bank transaction, PayPal, cashier's check or any other agreed upon mode of payment.
- Significantly misrepresent an item as identified within the item description.
- Refuse to accept payment, if the buyer was the resulting winning bidder at the end of a successful auction.
Violators may be subject to any one of several actions, including temporary or permanent suspension as a Member and user.
